We discuss the origin of rate independent hysteresis in martensites. We argue that during the "plastic" flow material is being driven through a succession of minimally stable states. This means, in particular, that the maximally stable configurations delivering the global minimum to the energy are hardly accessible. One of the signatures of marginal stability of the quasi-statically driven system is the criticality revealed by the power law acoustic emission. We show that this effect is lost in 1D models but can be recovered already in the simplest 2D modeling.
